Not sure why you want to go to Consulate in India and why you have to mention to them about the 22 days. H1 will not be processed in the Consulate in India, it will be processed only here. If you are saying that in future when you go to the US Consulate in India for stamping then its not needed to mention about the 22 days, since you filed before the I-94 expiration. Do have a soft copy of the FexEx receipt saved for your future use.

I entered US on H1 and the officer stamped the I-94 expiry date to the expiry date of the passport. I applied for a new passport but forgot about the I-94 expiry date. Does it mean that my H1B is expired and not valid? Can I re-enter US on the same H1B visa. Or, my H1B is no longer valid and I have to use AP?

Please let me know.

When did your I94 expired?

Even though it expired and if you are having a EAD you are legal.

Your H1B visa is still valid. If you want you can reenter using the same H1B Visa.

All you need is to extend your stay. I think you can do it by contacting CBP office in your area.

Query on behalf of a friend -

What are the timelines for I-539 Change of Status for H1 to H4?
Is premium processing option available for the this change of status?

Friend worked till last week of pregnancy (clean H1 history before). Her 12 weeks of maternity leave is ending soon and looks like the family needs to pay attention to child's condition and she has no choice but to become a full-time mom (another full-time job in itself though). She was in status during her maternity leave (some part of which was covered by STD insurance, remaining unpaid leave totaling 12 weeks under FMLA). She needs to change her status from H1 to H4.

- File for H1-H4 ASAP with in the unpaid leave window
- No premium processing available for H4

Can the core group let us know what are they targeting right now? Are they targeting CIR next month? The lack of direction will really lead to less contribution. Without that,I will have a hard time convincing other friends about IV.

Hi,

I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?

This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

The policies that are supposed to help recovery are being worked on and will take time to show results. Remember nobody felt the recession until 1 year after it actually started. While waiting for the policies to take effect or show results ,positive or negative, they can act on other things that are important.
All other activities are not being carried out while ignoring the economy. They are trying to multi-task.
Think of it this way. When dinnertime comes around, mom may be preparing dinner and watching TV at the same time.It doesn't mean she is ignoring the family needs.

Hi - I am on 7th Year of my H1. My I-140 has been approved. My I-485 is pending for while plus my PD is not current as of Jan 09. In this case...

a) Am I eligible to apply for H1 extension (I don't want to use EAD)?

Yes, you can apply for H1 extension when I-485 is pending

b) If Yes, will I get 1 Year or 3 Years?

Once I-140 is approved, you will get an extension for 3 years.
