Hi Guys,
I need your opinions/suggestion regarding the following:
I am working as a software professional, my job is a permanent full time job.
I got a labor certification and 140 is still in the process. I am willing to own a company and buying 100% of its shares(not a listed company). The company is incorporated in the state of Michigan. It is a small business company. I will not be serving the company's operations in regular hours and will not be actively involved in the day to day business. I will not be given any designation in the company.
I have the following questions if I own this company:
1. will this have any effect on my current or future any stages(140/485) of Green Card If I own this company.
2. After I own the company, Can I transfer the company profit funds from company bank account to my personal account.
3. Is it possible to own a company without any designation given.
4. After i own this company, will it be treated as I have 2 jobs.

If you have filed G28, your attorney on record will get the approval notice (3 hard copies).
On USCIS website, my I131 messages says as Document approved and..so on on Nov 1. Till date I haven'yt recd. any copies yet. Will it come to me or Lawyers?

I am on H1-B and have an EAD. My Dad is a builder in Hyderabad and I want to promote the apartments in US. Can I rent an office space and just do marketing without registering a business? All sales will be completed in India.

I think someone has given you incorrect information.
A visitor can stay for a maximum of 6 months (180 days - unless person is given earlier date in I-94, which is not usual) At a stretch. If person returns before 180 days, he/she can come back within a day and get a new I-94 and again can stay for 6 months (180 days or the date written on new I-94).
So, person's stay is not governed by number of days in a year, but by the date which is written on I-94. As long as she gets new I-94 with new date, she can stay until that date.
As a side note, what you are confusing with is the tax requirements, which is: If you are claiming a person to be your dependent, he/she must have stayed in the country for atleast 6 months in a calendar year.

H-1B through non-profits like Universities does not have a cap. Your only bet would be to find a job through one such an entity and apply for H-1B. Then you can pursue H-1B through any commercial entity during 2008 quota starting from April 2007.

what is new about what is being said in this article? We all know that bill is unlikely this year. Bush does not have a control over what happens in Congress. I went to graduate school in the US, (majored in Architecture) and was on an F1 visa from the period 2006-2009.I graduated in Aug 2008 and applied for an H1 through a consultancy firm.The petition for an H1 visa was approved, but I decided to return back home anyway and came home in 2009.
2 weeks ago, I visited the States for a week for a conference on a B1/B2 visa. I eventually want to return to the States and work there and therefore, need advice in this regard...
Given that my petition for an H1 has been approved, will the company that offers me employment have to reapply for an H1 for me?Or can the H1 be transferred from the Consultant company(that got me the H1), to the new company easily?!
Any help in this matter will be highly appreciated!

Hello All,
I have my EAD as does my wife. We are still on valid H1s (until 2009) and I have no plans to change my employer. We also received our travel documents. The question I have, and need your input on is can my wife travel (to India) and back on her H4 (even though we've filed for adjustment of status) or does she have to use her Advance Parole to do so?

If new position is similar in responsibilities, then no effect. but if the responsibilities are changing, I would recommend talking to your immigration lawyer about it
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

To best of my knowledge, a person on EAD (probably not the primary candidate) can work for anyone.. It can be City, State, Federal or McDonald's at any position, part time or full time, provided the job does not involve any government classified information. Jobs involving classified information are only for citizens that too after proper background check.
Primary candidate might work for the government i.e. if job requires skills that citizens don't have and that group has a policy of filing H1's..
