As far as i know, it is not possible. because your friend's I-140 was approved already, based on which I-485 was applied.
He can change an employer and shall not be any issue as long as the job description is same.
That doesn't equate to a situation where an employer can invoke I-140 before it's approval & use the LC for someone else.

are there any chances of any nurse or schedule A relief bill this year or even in 2010?.......is it going to be an eternal wait for us?.....will there ever be any bill/law to give us any separate gc numbers even though the shortage continues to grow??

My H1-B was approved in octubre 2008, I would like to go to my home country but i don't have a visa to be able to come back.
Now my question is:

My wife last time entered to US with H4 in June 2010. Then she applied for F1 status and got approved in Nov 2010.
H4 visa stamping Expires on Feb 20111.
She is planning to go India by Jan 2011 for 2 weeks. She is planning to come before Visa expires.
Is it possible to enter US with old H4 visa stamping?
Do we really need to stamp visa with F1?
F1 visa stamp is needed if she plans to continue her studies on F1 and would like to avail OPT.

i was on opt and my opt ended jan 24th 2009. i had applied to a masters program for spring 09. my old school ( where i did my bachelors) transfered my sevis information to my new school( where i was to start masters). however i decided to discontinue with my new school's masters program. i did not registered for classes. i told them that i would no longer want to pursue that particular masters anymore. i now want to join another institute for a short time. they require my sevis information in order to make an i20 for me. my new school( where i had applied for masters) says that they do not have an i20 for me since i cancelled my program. whichever institute i transfer to for future studies would require a copy of a current i20 from me for admissions.
now where does this situation leave me? am i out of status as of now? will i be able to transfer to any university/institute for my future studies?

We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.
“My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. Please suggest me the best option as i am still undecided.
My employer terminated my employment when I lost my job with the client company during 2nd week of June 2009. Before termination, my employer filed my GC and I have my EB2- 140 approved (PD- Feb 2007) and also My previous H1 extended last year 2008 and they have issued my visa for another 3 yrs (3rd term in H1). Since then I am without job and looking for an opportunity. But to be on safe side I left the country before the 30 days of my termination. I came back to US on H4 visa (so that I will be in-status and my GC won't get affected).
Now i am getting an opportunity for a FT position with a company and now I am undecided what to do? If I took the FT with a new company and then my GC process will start from beginning (applyng labor and then once approved (don't know how long it will take to approve labor in EB2) I can then file for 140 porting my previous approved 140 -eb2 with PD Feb 2007) or Just wait until I find a contract job and go through my previous employer and continue my GC process from where it is left.
Currently the PD for EB2-I is in 2005. So should I wait and go smoothly with my previous employer (but still we don't know how long it will take) or go with the FT.
Please suggest me.

I have a question on the receipt number. If we get the receipt number, does it mean "The application is accepted" (All the supporting documentation and fee are coorect)?

I believe you pay 10% penalty if you withdraw before retirement age, irrespective of whether you reside in the US at time of withdrawal.
However, note that it *might* be possible to save on taxes because you might have very little other US income in the year you withdraw. One dependency here is what tax laws and treaties your home country has on foreign income.

if 6 years completed without an LC/I-140, then if someone moves to H4, does LC+I_140 in say 5-6 months, can he/she come back to H1 (3 year extension?)

Not a legal advise. My 2 cents.
I have never heard of employers pulling credit history to decide upon job offers. I have changed jobs when I had no credit history and when credit history was bad (in 500s) because of outstanding debt (no delinquency though), never had any issues.
Hi, I would like to change job but my credit history is so bad. credit score is in recovery stage. I was unable to pay credit card debt and worked with settlement company and settled all the cards..I paid every thing as of last month. But there were delequencies still appearing on my report..
I am working for a decent company, but i would like to change the job due to uncertainity and very less compensation..
It is very very urgent. Can some one suggest if there will be any issues that matters job switching. In general, will the companies pull credit reports and deny jobs based on credits...Will the credit history matters.. I did not had any foreclosures or bankruptsy.
Plz plz suggest..looking for a way around..

President Obama promised during the election campaign that Immigration reform will be high on his list once elected president. Speaking to Hispanic reporters at the White House, Obama said last week he hopes a bill for comprehensive immigration reform will be drafted by the end of this year.
Obama tapped Homeland Security Secretary Janet Napolitano on June 25 to work with Congress to speed up immigration reform as senators warned another failed effort could doom chances for a generation. Obama said he asked Napolitano to meet regularly with lawmakers to systematically work through a number of controversial issues, such as how to handle the 12 million illegal immigrants already in the United States and how to prevent future illegal immigration.
The president has been criticized for not following through on a campaign pledge to tackle the issue this year. He has urged the Democratic-controlled Congress to start pushing now to pass legislation.
bama joked that his opponents had another reason to block his immigration reform effort: "There are many members of the Republican Party who think now that I am illegal immigrant," he said.

U.S. Department of Homeland Security Secretary Janet Napolitano today traveled to Laredo, Texas to announce more than $47 million in fiscal year 2010 Operation Stonegarden grants for the Southwest border states. She also met with law enforcement leaders to discuss the Department�s efforts to support state, local and tribal law enforcement in protecting communities from cross-border threats. She said, "Over the past year and a half, this Administration has pursued a new border security strategy with an unprecedented sense of urgency, making historic investments in personnel, technology and infrastructure while combating transnational criminal organizations that smuggle weapons, cash and people across our shared border with Mexico.� She said that Operation Stonegarden is one part of our overall strategy to provide state, local and tribal law enforcement on the frontlines the resources they need to confront the complex and dynamic challenges that exist along our borders.
The fiscal year 2010 Operation Stonegarden grants�totaling $60 million nationally�support 15 border states and the Territory of Puerto Rico to enhance the capabilities of federal, state, local and tribal law enforcement agencies to secure U.S. borders and territories. Funds were allocated using CBP�s sector-specific border risk methodology based on threat, vulnerability, miles of border and border-specific law enforcement intelligence. Nearly 80 percent of the fiscal year 2010 funding will go to Arizona, California, New Mexico and Texas�up from 59 percent in 2008.
